I,  acknowledge that all my questions have been answered to my full and total satisfaction. I specifically acknowledge that I have been advised of the facts and matters set forth below, and I agree as follows:

  • I am not pregnant or breastfeeding.
  • I do not have any medical or skin conditions such as but not limited to the ones listed above.
  • I do not have acne, scarring, eczema, psoriasis, moles that have a concerning appearance or sunburn in the area to be tattooed that may interfere with said tattoo. If your artist deems the area to be tattooed a risk, I acknowledge my artist has the right to refuse tattooing the area.
  • If I have any type of infection, bacteria, fungus or rash anywhere on my body, I will advise my tattoo artist.
  • I have not ingested blood thinners such as aspirin, ibuprofen within 24 hours prior to receiving the body art procedure.
  • I have not consumed alcohol, drugs or other substances within 24 hours prior to receiving the body art procedure.
  • I am currently not under the influence of alcohol, drugs or other substances.
  • I understand that any of those substances (medications, alcohol, drugs and others) may directly affect the procedure and healing process of my tattoo.
  • I acknowledge that there is a chance I might feel lightheaded, dizzy during or after being tattooed. I agree to immediately notify the practitioner in the event I feel lightheaded, dizzy and/or faint before, during or after the procedure. I acknowledge that vomiting is also a potential side effect during and after the procedure.
I have been fully informed of the inherent risks with getting a tattoo. Therefore, I fully understand that these risks, known and unknown, can lead to injury including but not limited to: infection (including bacterial endocarditis for patrons with a heart disease), scarring, difficulties in detecting melanoma, and allergic reactions to tattoo pigment, latex gloves, and antibiotics. I understand there is a risk of fainting or vomiting. Having been informed of the potential risks associated with getting a tattoo, I still wish to proceed with tattoo application and I assume any and all risks that may arise from tattooing.

I, acknowledge receipt of written instructions advising me of proper care of my tattoo and recognize the absolute necessity of following those written instructions. I acknowledge that infection is always possible as a result of the obtaining of a tattoo, particularly in the event that I do not take proper care of my tattoo.

I acknowledge that I have been given the full opportunity to ask any and all questions I might have about obtaining a tattoo from my artist at Black Sol Tattoo | Zelaya Tattoos LLC. I acknowledge that all my questions have been answered to my full and total satisfaction. I specifically acknowledge that I have been advised of the facts and matters set forth below, and I agree as follows:
  • I understand that a tattoo is a permanent change to my appearance and can only be removed by laser or surgical means, which can be disfiguring and/or costly and which in all likelihood will not result in the restoration of my skin to its exact appearance before being tattooed.
  • I understand that my artist is not responsible for the meaning or spelling of the symbol or text that I have provided to them or chosen.
  • I realize that variations in color and design may exist between any tattoo as selected by me and as ultimately applied to my body. I understand that my skin tone will change the final appearance of the pigment under my skin. I also understand that over time, the colors and the clarity of my tattoo will fade due to unprotected exposure to the sun and the naturally occurring dispersion of pigment under the skin.
  • I release the right to any photographs taken of me and the tattoo and give consent in advance to their reproduction in print or electronic form and publication on any social platforms.
  • I waive and release to the fullest extent permitted by law any person of the tattoo studio, Black Sol Tattoo | Zelaya Tattoos LLC, from all liability whatsoever, including but not limited to, any and all claims or causes of action that I, my estate, heirs, executors or assigns may have for personal injury or otherwise, including any direct and/or consequential damages, which result or arise from the procedure and application of my tattoo, whether caused by the negligence or fault of either the tattoo studio, Black Sol Tattoo | Zelaya Tattoos LLC, or otherwise.
  • I agree to reimburse the tattoo studio, Black Sol Tattoo | Zelaya Tattoos LLC and any tattoo artists performing at the studio for any attorney's fees and costs incurred in any legal action I bring against the tattoo studio, Black Sol Tattoo | Zelaya Tattoos LLC, and in which either the artist, of the tattoo studio, Black Sol Tattoo | Zelaya Tattoos LLC, is the prevailing party. I agree that the courts located in the County of Salt Lake within the State of Utah shall have jurisdiction and venue over me and shall have exclusive jurisdiction for the purposes of litigating any dispute arising out of or related to this agreement.
  • I acknowledge that I have been given adequate opportunity to read and understand this document that it was not presented to me at the last minute and grasp that I am signing a legal contract waiving certain rights to recover damages against the tattoo studio, Black Sol Tattoo | Zelaya Tattoos LLC and any artists performing at this studio. I have read this form and confirm that all the information I have given is correct. I understand that this is a release form and I agree to be legally bound by it.
  • I acknowledge I am over the age of eighteen and that I have truthfully represented to my tattooer that the obtaining of a tattoo is by my choice alone. I consent to the application of the tattoo and to any actions or conduct of the representatives and employees of the tattoo shop reasonably necessary to perform the tattoo procedure.

   

Deposit Agreement

This NON-REFUNDABLE deposit is a guarantee that you will show up on the agreed time and date for your appointment with Gustavo Zelaya. 

  • A deposit is required for each appointment date you wish to reserve. This deposit will be subtracted from the final price of each corresponding appointment.
  • Deposits can be accepted via Venmo or in person cash ONLY.
  • Deposits are NON-REFUNDABLE. 
  • Should you need to reschedule your appointments) for any reason, please make sure to do so NO LESS THAN 3 DAYS before your set consultation date (or, your soonest appointment date, if no consultation has been set). If you fail to do so, you will forfeit your deposit and be required to make another deposit in order to reschedule.
  • You are allowed up to (1) reschedule. After that your deposit must be forfeited and a new deposit must be placed in order to secure a new appointment date.
  • If you fail to show up to your appointment, you will forfeit your deposit and be required to make another deposit in order to reschedule. You will also be required to re-submit your inquiry during our next booking period. 
  • lf, for any reason (including but not limited to: illness, government mandated closures, personal emergencies, ect), the artist must reschedule your appointment, your deposit will be honored and transferred to a new appointment date without penalty.
  • If, in the event that you may be running late to your scheduled appointment time, notice must be given so the shop can plan accordingly. Your appointment time will be given to you after a deposit has been made and your booking dates confirmed. 
  • This does not supersede the above rescheduling policy and is only applicable in the event you are more than 10 minutes late to your scheduled appointment time.
  • If you are more than 1 hour late to your scheduled appointment time your appointment must be rescheduled and your deposit for that day will be forfeited.
    • In order to schedule a new appointment date a new, separate deposit must be provided.
 

Gustavo reserves the right to refuse service to anyone, regardless of the status of their deposit. By agreeing in the booking request, you have read and agreed to all aforementioned terms, and agree to be present on the date of the consultation and appointment set by the artist and or the artist’s management.
